Once we receive your payment and completed Analysis Questionnaire, we will begin work on your order. Please allow 7-10 business days to complete. The results of the analysis will be emailed to you in a comprehensive report in PDF format to the email provided.

TERMS OF SEVICE & AGREEMENT
This agreement is between Meritage Realty, Inc., and you, the client, for Comprehensive Real Estate Analysis. The agreement is effective when the real estate analysis is ordered and paid for. In this Agreement, the party who is contracting to receive services shall be referred to as “Client”, and the party who will be providing the services shall be referred to as “Meritage Realty, Inc” a licensed Real Estate Firm with the California Department of Real Estate (DRE) License No. 01782267.
A. IMPORTANT NOTICES
- Please review this entire agreement before agreeing to its terms and ordering real estate analysis to be performed.
- Your analysis is completed by staff of Meritage Realty, Inc. namely, Cheryl Cooper (also known by maiden name Nielsen).
- Cheryl Cooper is not an Attorney or a Certified Public Accountant. Therefore no legal advice will be provided. Discussions can skirt legal issues and should be interpreted as opinions, or things to consider. If legal advice is desired, consult with an appropriate Attorney. Tax ramifications of any options need to be confirmed by a Certified Public Accountant or a Tax Professional that takes into consideration all your unique factors that impact your ultimate tax consequence. We do not review your tax returns, we provide general tax guidelines specific to the options we analyze that assist in your tax planning with your Tax Professional. Discussions and services do involve accounting and presentation of financial results and/or projections. Any estimations or projections of possible tax circumstances should be reviewed by a Tax Professional for accuracy. The scope of the service is to identify potential tax ramifications.
- Cheryl Cooper is the licensed California Real Estate Broker with Meritiage Realty, Inc. DRE No. 01382534 and is certified to perform this analysis as a Certified Divorce Financial Analyst® (Certified under maiden name Cheryl Nielsen) and Certified Real Estate Divorce Specialist®. Our analyst model is trademarked under the designation “Forensic Real Estate Divorce Strategist®” all rights reserved.
- Included in the real estate analysis, under the appropriate option, is a comparative market analysis which is a market comparison of properties with similar square footage, bedrooms, and bathrooms. The comparative market analysis (CMA) is a “snapshot” of what similar properties are selling for in the area. The comparative market analysis can not consider all the unique factors which may contribute to the actual market value of the property. It will be up to you to compare your property to that of others for the closest similarities. You may also seek the services of a licensed appraiser if you would like the property inspected and an opinion of value.
B. DESCRIPTION OF SERVICES.
- Beginning when payment and the analysis questionnaire is completed and received, Meritage Realty, Inc. will provide the following services (collectively, the “Services”) as part of the Comprehensive Real Estate Analysis for the options ordered including any of the following that apply to your option:
- Review and report market conditions/trends where the property is located
- Estimate Current Market Value (Comparative Market Analysis)
- Review title records (current deed & trust deed) and report on findings
- Review Mortgage & Title History and report on findings related to separate property issues, etc.
- Estimate Equity Value in Property
- Calculate Approximate Seller’s Cost to Sell and Net Proceeds
- Explore Separate Property & Community Property Issues
- Explore and/or estimate Gains on future Sale
- Identify IRS tax provisions that may apply under options being considered
- Provide summary recap of the pros and cons of each option
- Include an Attorney/Mediator section to recap tax provisions for your settlement agreement for options
- Provide instructions for title changes and nuances of specific types of deed transfers
- Report on market rental rates for like property
C. CANCELLATION & TERMINATION.
- You may cancel this contract for any reason within 24 hours after you agree to the terms of service, fill out the questionnaire, and pay.
- To cancel this agreement, send Meritage Realty, Inc. a written notice of cancellation by facsimile or electronic transmission within 24 hours.
- If you cancel the agreement for any reason under these terms, Meritage Realty, Inc. will immediately refund in full any fees which you have paid, less any transaction fee charged by PayPal when you placed your order.
- If you submit an incomplete questionnaire, we will notify you. If we do not receive a response, this agreement will be void after 2 months. You will be refunded at that time for your payment less any transaction fee charged by PayPal when you placed your order.
D. DISPUTES.
- MEDIATION – ARBITRATION.
“All disputes arising out of this agreement shall be submitted to mediation in accordance with the rules of Arts Arbitration and Mediation Services, a program of California Lawyers for the Arts. If mediation is not successful in resolving all disputes arising out of this agreement, those unresolved disputes shall be submitted to final and binding arbitration. The arbitrator shall be selected in accordance with the rules of Arts Arbitration and Mediation Service. If such services are not available, the dispute shall be submitted to arbitration in accordance with the laws of the State of California. The arbitrator’s award shall be final, and judgment may be entered upon it by any court having jurisdiction thereof.”
E. OTHER.
- EMPLOYEES. Meritage Realty, Inc. employees, if any, who perform services for Client under this Agreement shall also be bound by the provisions of this Agreement.
- CONFIDENTIALITY. Client recognizes that Meritage Realty, Inc. has and will have information provided by Client or Third Party to perform services and will not divulge, disclose, or communicate in any manner any of this information to outside parties unless authorized by Client or Third party.
- CONFIDENTIALITY AFTER TERMINATION. The confidentiality provisions of this Agreement shall remain in full force and effect after the termination of this Agreement.
- RETURN OF RECORDS. Upon termination of this Agreement, all paper records supplied to Meritage Realty, Inc. by Client will be returned.
- NOTICES. All notices required or permitted under this Agreement shall be in writing and shall be deemed delivered when received at the following addresses: Meritage Realty, Inc. P.O. Box 27, Newport Beach, CA 92662. or Fax 310.933.0296 or Email Cheryl@MeritageRealtyInc.com. Client notices will be emailed to the email address provided by client. Such address may be changed from time to time by either party by providing written notice to the other in the manner set forth above.
- ENTIRE AGREEMENT. This Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.
- AMENDMENT. This Agreement may be modified or amended if the amendment is made in writing and is signed by both parties.
- SEVERABILITY. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
- WAIVER OF CONTRACTUAL RIGHT. The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Agreement.
- APPLICABLE LAW. This Agreement shall be governed by the laws of the State of California.
